Information Form for Travelers on Package Tours
According to §651a of the German Civil Code (BGB)
  • Travelers receive all essential information about the package tour before concluding the package travel contract.
  • At least one operator is always liable for the proper provision of all travel services included in the contract.
  • Travelers are provided with an emergency phone number or contact details for a contact point through which they can communicate with the tour operator or travel agency.
  • Travelers may transfer the package tour to another person within a reasonable period and possibly at additional costs.
  • The price of the package tour may only be increased if specific costs (such as fuel prices) increase and if this is expressly provided for in the contract, and in any case, no later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveler may withdraw from the contract. If a tour operator reserves the right to increase prices, the traveler has the right to a price reduction if the respective costs decrease.
  • Travelers can withdraw from the contract without paying a cancellation fee and receive a full refund of all payments if one of the essential components of the package tour, except for the price, is significantly changed. If the operator responsible for the package tour cancels the tour before it starts, travelers are entitled to a refund and possibly compensation.
  • Travelers can withdraw from the contract without a cancellation fee under extraordinary circumstances before the start of the package tour, for instance, if there are serious security issues at the destination that are likely to affect the package tour.
  • Additionally, travelers may withdraw from the contract at any time before the start of the package tour by paying a reasonable and justifiable cancellation fee.
  • If essential components of the package tour cannot be provided as agreed upon after the start of the tour, suitable alternative arrangements must be offered to the traveler at no additional cost. The traveler may withdraw from the contract without a cancellation fee (known as “termination” in Germany) if services are not provided according to the contract and this significantly affects the provision of the contractual package tour services, and the tour operator fails to remedy the situation.
  • The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided adequately.
  • The tour operator provides assistance if the traveler encounters difficulties.
  • In the event of the insolvency of the tour operator or – in some member states – the travel agent, payments will be refunded. If the insolvency of the tour operator or, if applicable, the travel agent occurs after the start of the package tour and transportation is part of the package tour, the return transportation of travelers is ensured.
